Why don't the court consider his mother evidence as "Siya had already attempted to murder him." as dying declaration evidence said by Ketan himself and added that "Siya is also the one, who is nearer to him at the last moment of Ketan's life". Under Section 26 of the Bharatiya Sakshya Adhiniyam, 2023 (BSA)—formerly Section 32(1) of the Indian Evidence Act, 1872—a dying declaration is not limited only to the immediate cause of death. It also covers "any of the circumstances of the transaction which resulted in his death."
